Witch hunt...

Looks like there is a witch hunt going on....

Oh, we all know what i mean, it's splashed in all the papers.. RPK being held in prison under the Sedition Act, which as i have posted before.... and to be more exact, the section shall be provided here as well... (For the full act --> Sedition Act 1948)

S. 3(1) of the Sedition Act 1948 defines
A “seditious tendency” as a tendency to:


(a) bring into hatred or contempt or to excite disaffection against any Ruler or against any Government;

(b) excite the subjects of the Ruler or the inhabitants of any territory governed by any government to attempt to procure in the territory of the Ruler or governed by the Government, the alteration, otherwise than by lawful means, of any matter as by law established;

(c) bring into hatred or contempt or to excite disaffection against the administration of justice in Malaysia or in any State;

(d) raise discontent or disaffection amongst the subjects of the Yang di-Pertuan Agong or of the Ruler of any State or amongst the inhabitants of Malaysia or of any State;

(e) promote feelings of ill-will and hostility between different races or classes of the population of Malaysia; or

(f) question any matter, right, status, position, privilege, sovereignty or prerogative
established or protected by the provisions of part III of the Federal constitution or Article 152, 153 or 181 of the Federal Constitution.

And here is the section which RPK is being held under: He is being held under Section 4(1) (c) for publishing seditious material...

S4(1) Offences: Any person who-

(a) Does or attempts to do, or makes any preparation to do, or conspires with any person to do, any act which has or which would, if done, have a seditious tendency;

(b) Utters any seditious words

(c) Prints, publishes, sells offers for sale, distributes or reproduces and seditious publication, or;

(d) Imports and seditious publication,

shall be guilty of an offence and shall, on conviction, be liable, for a first offence to a fine not exceeding five thousand ringgit or to imprisonment for a term not exceeding three years or to both, and, for a subsequent offence, to imprisonment for a term not exceeding five years; and any seditious publication found in the possession of the person or used as evidence at his trial, shall be forfeited, and may be destroyed or otherwise disposed off as the court directs.

I've read the article in which they are claiming to be seditious... and honestly I personally don't find it seditious, if i recall correctly, that certain person's name wasn't even mentioned..

To be honest, I feel that the Sedition Act is like a Dinosaur and ought to be repealed... but will they do it? It totally curbs our freedom of speech.. We need to incorporate the Humans Rights Act 1996!!

Anyway, I shouldn't speak so much about repealing it, less I be dragged to court as well one fine day....

where was I?... oh yes, RPK being summoned to court, it was interesting to note that RPK even started a fund for his law fees, and well he only needed RM5, 000 to post bail (which he denied, and preferred to languish in prison till October..) and he got at least 5 times that amount, see where this is leading to? He has the people's support, BN is digging its hole even deeper...

It's no secret, the government blames bloggers for the March 8 elections, and one of the contributors to this, they say is Malaysia Today.

Now i won't deny that Malaysia Today did not play a part, but heck, even without Malaysia Today, I was pretty certain who i was going to vote for, i don't need blogs to tell me that I'm living like a second class citizen in my own country, i don't need a blog to tell me that our university educations aren't very good.... and where we can afford it, we are off to private institutions... Heck i don't even need the blogs to tell me about the quota systems which are so being so vigorously denied...

I'm neither blind nor deaf, i can see and hear all these for myself.. I don't need the internet to tell me that.... if they want to charge RPK or at the very least get rid to him, because they blame him for the March 8 elections then, what about Malaysia Kini?

As a blogger, I'm abhorred that we are not given an outlet to express ourselves, whatever i just said above can be charged as seditious as well I guess, going by the looks of things... but guess what? those are my experiences from living in this country.. can they deny that? ask any Non-Bumi Malaysian in KL....

Is too vague, with this, anything you say, can be held as seditious, explains why so many leaders from PKR were put under the ISA...

It's such an archaic act, it really ought to be repealed..

Besides on another note, don't you think that it is illogical that he is being held under the Sedition Act? Read the article for yourself, in no where did he explicitly write anything in hatred or contempt of the Monarchy or the Government...

At most, it was merely referring to a certain person, which mind you, the main stream media themselves have reported to be supposedly involved in the case.. Why don't you arrest them then under the same act?

Isn't it weird? Why don't they charge him for slander? or libel instead? it should be a case of defamation don't you think? --> is it really an abuse of Government power?

It really looks like a witch hunt to me, no matter how i look at it..... something which they started in August 2007, ceased, and have brought up again in the light of the election results two months ago...

I personally don't think that it is a smart move.. if their motive is to scare others or what so ever.. At the rate they are going, instead of admitting their arrogance, and corruption, but still searching for a scape goat to blame... come next election.. I don't think we will be seeing BN sitting at the top anymore...

They know what the problem is, yet they are still in denial after two months, with the blame shifting... and calls to step down... I don't think they will survive long unless they get their act together... even then there is no guarantee, the people have spoken, on this one....

On another note, i am disgusted with the turns of Balkis...

As a society that claims to be a charitable... i really don't understand the need to dissolve the society and transfer the funds.. it only causes speculations to arise.. and to add to that shouldn't all charitable organisations be apolitical????

it is the same as with the NGOs that came out to protest.. i was left wondering, what the heck were they playing at...

NGOs, non governmental organisations.. doesn't that mean that they are apolitical as well...

Damn they are politicising every damn thing for their benefit...

Well there's plenty i would love to say, but with the sedition act in place, unfortunately i will have to hold my tongue..

All i can say is that, BN is naive to think that blogs such as RPK's was the cause of this elections turn out...

They didn't take into account that at least 2 million of the voters are young voters, who don't fear May 13, because for one, we don't know what it was like, only what we can read from the archives, and we believe that we are more mature and educated than 39 years ago....

Also these new voters are more open, and daring to voice out their opinions, who do not wish to be treated as, nor see other Malaysians being treated as second class citizens. This is a new generation of Malaysians!!

Not Malay Malaysians nor Chinese Malaysians nor Indian Malaysians, we are the 3rd or 4th generation born here on this soil since Malaysia achieved her independence 50 years ago, we don't see ourselves as illegal immigrants, and we want equality... And that's where BN missed out...

This is a very good point which you'd pointed out. We've the write and I don't know why 'they' have to prison someone who's trying to voice out his opinion?
